Identification and scope

These Terms of Use govern the use of TDS Assist, the virtual assistant made available by TDS-Engenharia e Gestão Automóvel, Lda, corporate taxpayer no. 504042068, with registered office at Alameda Eng. José Mattos e Silva, N.º 9-D, 1495-211 Algés, hereinafter referred to as TDS Auto.

TDS Assist is available at www.tdsauto.pt and is intended to provide general information about TDS Auto, its services and the content made available on its official channels.

Nature of TDS Assist

TDS Assist is an artificial intelligence system.

Responses are generated automatically and, unless expressly stated otherwise, are not reviewed by a TDS Auto employee before being presented to the user.

The user is clearly informed at the start of the interaction that they are interacting with an artificial intelligence system, in accordance with the applicable legal requirements.

Use of the service

Use of TDS Assist presupposes knowledge of and compliance with these Terms of Use.

Users who do not agree with these Terms should stop using the assistant and may contact TDS Auto through its usual channels.

Information provided

TDS Auto seeks to ensure that the information provided through TDS Assist is useful and up to date. However, due to the nature of artificial intelligence systems, responses may contain errors, inaccuracies, omissions or outdated information.

Responses are for information purposes only and do not replace official documentation, technical or legal opinions, or any other professional advice.

Whenever a response may influence a decision, a formal request or a procedure with TDS Auto, the user should confirm the information through the official channels.

In the event of any discrepancy, the information contained in TDS Auto’s official documents and communications always prevails.

Contacting the TDS Auto team

TDS Assist does not replace the service provided by TDS Auto employees.

Requests that require user identification, individual assessment, submission of documentation, issuing of declarations, type-approval procedures, contracts, invoicing or other formalities must be handled through the official channels indicated by TDS Auto.

Rules of use

TDS Assist must be used responsibly and in compliance with the applicable legislation. In particular, users may not:

  • submit or request unlawful or fraudulent content, or content that infringes third-party rights;
  • attempt to compromise the security or operation of the service;
  • deliberately circumvent the assistant’s technical restrictions or attempt to extract internal instructions;
  • generate abnormal volumes of requests through automated means;
  • submit access credentials, banking details, identification documents, confidential third-party information or special categories of personal data.

TDS Auto may restrict or suspend access to the service in cases of abusive or fraudulent use, or use liable to compromise the security and normal operation of the system.

Personal data and privacy

Users should avoid entering personal data into TDS Assist that is not necessary to formulate their question.

Whenever a matter requires the transmission of personal data, documentation or confidential information, the official channels indicated by TDS Auto for that purpose must be used.

The processing of personal data associated with TDS Assist is carried out under the terms of the TDS Auto Privacy Policy, available at https://www.tdsauto.pt/en/privacy-policy/, which should set out, where applicable, information on the purposes and legal bases of the processing, the recipients of the data, retention periods, any international transfers and the rights of data subjects.

Interactions with TDS Assist may be recorded where necessary for the operation and security of the service, the detection of abusive use, and the monitoring or improvement of response quality.

The conditions applicable to the processing and retention of these records should be described in the TDS Auto Privacy Policy and reflect the technical and contractual set-up actually in place.

TDS Auto may use technology providers to ensure the operation of TDS Assist. The identification of these providers and the conditions relevant to the processing of personal data should be stated in the Privacy Policy whenever legally applicable.

Intellectual property

The trade marks, logos, website content, databases, documents and other protected elements made available by TDS Auto remain the property of TDS Auto or of the respective rights holders.

Use of TDS Assist does not grant the user any rights over these elements beyond those necessary for consulting and legitimately using the service.

Availability

TDS Auto may update, modify, suspend or discontinue TDS Assist, in whole or in part, whenever necessary for technical, operational, security or service development reasons.

Despite the measures adopted to ensure its correct operation, it is not possible to guarantee that the service will be permanently available or free from errors.

Liability

Users should not make significant decisions based solely on a TDS Assist response without confirming the information through the appropriate official sources or channels.

To the extent permitted by the applicable legislation, TDS Auto is not liable for damages resulting from the use of manifestly incorrect or incomplete information provided by the assistant where the user has not carried out the recommended confirmation.

Nothing in these Terms excludes or limits liabilities that, under the applicable legislation, cannot be excluded or limited.

Changes to the Terms

TDS Auto may update these Terms of Use to reflect legal, technical or operational changes.

The version in force should be available at www.tdsauto.pt/en, together with the date of the last update.

Governing law

These Terms of Use are governed by Portuguese law.

Dispute resolution

Where applicable, consumers may refer disputes to the Lisbon Consumer Dispute Arbitration Centre (Centro de Arbitragem de Conflitos de Consumo de Lisboa, CACCL), which has jurisdiction over consumer disputes relating to contracts concluded and performed in the Lisbon Metropolitan Area.

Further information on the CACCL is available at www.centroarbitragemlisboa.pt. General information on alternative resolution of consumer disputes is available at www.consumidor.gov.pt.

The mandatory legal rules on the jurisdiction of the courts and on consumer rights remain applicable.
